USER AGREEMENT
This Agreement (hereinafter referred to as the "Agreement") is made between the online store
"INTER PIGMENTS - Online Store", accessible at the website address https://inter-pigments.com,
hereinafter referred to as the "Online Store" or the "Website," and the user of the Online Store services, hereinafter referred to as the "Buyer," and defines the terms and conditions for purchasing goods through the Website.
1. General Provisions:
1.1. This Agreement is concluded between the Buyer and the Online Store "INTER PIGMENTS - Online Store" at the moment the order is placed.
The Buyer confirms their consent with the terms set forth in this Agreement.
1.2. This Agreement, as well as the information about goods presented on the Website, constitute a public offer in accordance with Articles 435 and part 2 of Article 437 of the Civil Code of the Russian Federation.
1.3. Relations between the Buyer and the Online Store "INTER PIGMENTS - Online Store" are governed by the provisions of the Civil Code of the Russian Federation on retail sale (§ 2, Chapter 30), as well as the Law of the Russian Federation "On Consumer Rights Protection" dated 07.02.1992 No. 2300-1 and other legal acts adopted in accordance with them.
1.4. The Buyer may be any individual or legal entity capable of accepting and paying for the ordered goods under the terms and conditions established by this Agreement within the territory of the Russian Federation.
1.5. The Online Store reserves the right to make changes to this Agreement.
1.6. This Agreement should be considered in the form published on the Website and shall be applied and interpreted in accordance with the legislation of the Russian Federation.
2. Information About Goods:
2.1. Goods on the Website are presented through photo samples, which are the property of the Online Store "INTER PIGMENTS - Online Store".
2.2. Goods may differ from the photo samples but will definitely correspond to the characteristics of the selected item.
2.3. Each photo sample is accompanied by textual information: price and product description.
2.4. Upon the Buyer’s request, the Online Store manager may provide (by phone or email) any additional information deemed necessary and sufficient by the Buyer to make a purchase decision.
2.5. The price indicated on the Website may be changed unilaterally by the Online Store but not after the order has already been placed by the Buyer.
3. Procedure for Purchasing Goods:
3.1. The Buyer has the right to place an order for any product presented on the Website. Any quantity of the product may be ordered. Orders can be placed by phone or independently on the Website. Detailed order placement procedures via the Website are described in the "Delivery" section.
3.2. After independent order placement on the Website, an electronic receipt confirming the order is sent to the Buyer’s e-mail; this receipt is an integral part of this Agreement.
3.3. If the product is out of stock, the Online Store manager must inform the Buyer (by phone or email).
3.4. The Buyer may place a pre-order for temporarily out-of-stock goods by making an advance payment as agreed with the Online Store manager.
3.5. If the product is unavailable, the Buyer may replace it with another product or cancel the order.
3.6. The Buyer has the right to refuse the ordered product at any time before shipment by notifying the Online Store in advance (by phone or email).
4. Delivery and Acceptance of Goods:
4.1. Delivery of goods ordered from the Online Store in the agreed quantity and assortment is carried out by courier services across Russia and CIS countries.
4.2. Delivery terms, costs, and availability to other countries must be agreed with the Website manager.
4.3. Delivery expenses are specified in the "Delivery" section and may be additionally agreed upon by the parties. Delivery may be paid or free of charge.
4.4. Shipment and delivery of ordered goods are carried out within the time frames agreed with the Buyer.
4.5. The Buyer must inspect the goods in the presence of the courier from "INTER PIGMENTS - Online Store" for quantity, quality, assortment, and completeness.
4.6. The fact of acceptance by the Buyer is the actual receipt of the goods either from the courier or the carrier.
5. Payment for Goods:
5.1. Payment methods are specified on the Website in the "Payment" section. Payment terms and conditions are agreed upon between the Buyer and the Online Store manager.
5.2. For cash payments, the Buyer pays by handing money to the Online Store’s representative or courier delivering the goods.
5.3. For non-cash payments, the Buyer makes a full prepayment by transferring funds to the Online Store’s bank account.
5.4. Payment is accepted only in Russian rubles.
6. Return of Goods:
6.1. Please note that perfumery and cosmetic products such as pigments, foams, cooling liquids, pencils, etc., are not subject to return or exchange according to the Government Resolution of the Russian Federation dated 19.01.1998 No. 55. The Buyer may refuse goods before shipment by Russian Post with cash on delivery or refuse fully pre-paid goods. Return of defective goods is possible if their appearance, consumer properties, or expiration do not correspond to the declared ones.
6.2. The Buyer cannot refuse paid but not yet shipped goods.
6.3. In the case of a lawful refusal, the Online Store refunds the amount paid for the goods no later than ten days after the Buyer submits a corresponding claim.
7. Miscellaneous:
7.1. The Online Store reserves the right to expand or reduce the product range on the Website, regulate access to the purchase of any goods, and suspend or terminate the sale of any goods at its sole discretion.
7.2. By using any functionality of the Online Store "INTER PIGMENTS - Online Store", this Agreement is considered concluded from your side, and all relations between the Website inter-pigments.com and you are governed by this User Agreement, which you undertake to comply with.
